§ 01 Acceptance

By accessing or using the 58 Dakota LLC website at 58dakota.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Site.

These Terms constitute a binding agreement between you and 58 Dakota LLC, a Michigan limited liability company with its principal office at 58 Dakota Street, Pontiac, MI 48341. "You" means any person who accesses or uses the Site, whether or not you become an applicant or tenant.

Your continued use of the Site after any update to these Terms constitutes acceptance of the revised Terms. We will post the date of the most recent revision at the top of this page.

§ 02 About these terms

These Terms govern your use of 58dakota.com and nothing else. They cover the website — how you may use it, what you may not do, and our respective rights and obligations as to the site itself.

These Terms do not govern or replace any other agreement you have with 58 Dakota LLC. If you are a tenant or have signed an application, your rights and obligations with respect to housing are determined by your written lease agreement and applicable Michigan law — not by anything on this website.

In the event of any conflict between what appears on this website and what is written in your signed lease, the lease controls.

Our Privacy Policy, available at 58dakota.com/privacy, is incorporated into these Terms by reference. By using this Site you also accept the terms of our Privacy Policy.

§ 03 Use of the site

You may use 58dakota.com for the following purposes:

  • Viewing available rental listings and property information
  • Submitting a rental application
  • Requesting maintenance service (current tenants)
  • Contacting our office with questions or inquiries
  • Reviewing our policies, office hours, and general information about 58 Dakota LLC

Prohibited uses

The following uses of this site are strictly prohibited:

  1. 1. Scraping and automated harvesting. You may not use any automated tool, bot, spider, crawler, or scraping script to collect content, contact information, listing data, or any other material from this site without our prior written consent.
  2. 2. Reverse engineering. You may not attempt to decompile, disassemble, reverse engineer, or otherwise discover the source code, server architecture, database structure, or underlying technology of this site.
  3. 3. Service disruption. You may not take any action that interferes with or disrupts the site, its servers, or networks connected to it, including distributed denial-of-service attacks, injection attacks, or other attempts to degrade performance or access unauthorized data.
  4. 4. Fraudulent applications. You may not submit an application containing knowingly false, misleading, or fabricated information. Doing so may constitute fraud under Michigan law and will result in immediate disqualification of any application and, if tenancy has begun, grounds for termination of the lease.
  5. 5. Harassment. You may not use the contact form or any other feature of this site to harass, threaten, or send abusive communications to our staff or to any other person.
  6. 6. Unauthorized account access. You may not attempt to access any tenant account, maintenance portal, or administrative system on this site without authorization. If the site provides tenant-facing secure features, you may only access your own account.

We reserve the right to block or restrict access to the site for any user who violates these Terms.

§ 04 Applications

Submission of a rental application through this site or in paper form does not constitute an offer of tenancy, and does not create any contractual obligation on the part of 58 Dakota LLC to lease a property to any applicant.

We evaluate applications based on stated criteria — credit history, rental history, income verification, references, and occupancy standards — applied consistently and in compliance with the federal Fair Housing Act and Michigan civil rights laws. We do not discriminate on the basis of any protected class. See § 05 for our fair housing commitment.

We may decline any application that does not meet our stated criteria, that contains material misrepresentations, or for any other non-discriminatory reason. We are not required to explain every declination decision, but we will tell you, in plain terms, that a decision was made.

Application fees, if charged, will be disclosed to you before payment is required. Application fees cover the actual cost of the background and credit check and are not refundable, as these costs are incurred whether or not a tenancy results. We do not charge application fees to generate revenue.

A tenancy begins only when both parties have executed a written lease agreement. Nothing on this website — a listing, a confirmation email, an approval email — constitutes a binding lease.

§ 05 Equal housing & fair housing

58 Dakota LLC is committed to equal housing opportunity and full compliance with the federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and the Elliott-Larsen Civil Rights Act of 1976 (Michigan's primary state civil rights statute governing housing).

We do not discriminate in the rental or provision of housing on the basis of race, color, religion, national origin, sex, familial status, disability, age, marital status, source of income, or any other characteristic protected by federal, state, or local law. This commitment applies to all aspects of our business, including advertising, application review, tenant selection, lease terms, maintenance services, and tenancy renewal decisions.

We are required by federal law to display the Equal Housing Opportunity logo and to make this commitment explicit. We do it because it is also the right thing to do and reflects how we have operated since 1958.

§ 06 Intellectual property

The text, design, graphics, photographs, copy, trademarks, and other content on 58dakota.com ("Site Content") are owned by 58 Dakota LLC or licensed by us from their respective owners. All rights reserved.

You may view, print, and download Site Content for your own personal, non-commercial use — for example, to save a copy of a listing you're considering or to print an application form. You may not:

  • Copy, reproduce, republish, or distribute Site Content for any commercial purpose
  • Modify or create derivative works from Site Content without written permission
  • Remove or obscure copyright notices, trademarks, or other proprietary markings
  • Use our name, logo, or branding in any manner that implies a false affiliation, sponsorship, or endorsement

Brief quotations from Site Content for purposes of criticism, comment, news reporting, or academic reference are permitted under applicable copyright law, provided proper attribution is given.

If you believe your copyrighted work has been reproduced on this site without authorization, please contact us at [email protected] with a description of the content, your ownership claim, and your contact information.

§ 07 Disclaimers

58dakota.com and all content and services offered through it are provided "as is" and "as available," without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, 58 Dakota LLC disclaims all warranties, including but not limited to:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement
  • Any warranty that the site will be uninterrupted, error-free, or free of viruses or other harmful components
  • Any warranty as to the accuracy, completeness, or timeliness of any information displayed on the site

Listing details — including rent amounts, availability dates, square footage, amenities, and photographs — are provided for informational purposes and are subject to change without notice. We strive to keep our listings accurate and up to date. But a listed rent is not a guaranteed rent until it appears in a signed lease, and a "available" status is accurate only as of the time it was last updated.

We try to be accurate. We are not making a warranty that we are.

The Site may contain links to third-party websites. We do not control those sites, endorse their content, or accept any responsibility for them. Following an external link is at your own discretion.

§ 08 Limitation of liability

To the maximum extent permitted by applicable Michigan law, 58 Dakota LLC, its principals, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of — or inability to use — this site or its content.

This includes, without limitation, damages for lost profits, lost data, loss of goodwill, service interruption, computer damage, system failure, or the cost of substitute services, even if we have been advised of the possibility of such damages.

In states and jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability is limited to the maximum extent permitted by law.

In any case, our total aggregate liability to you for any claim arising under or in connection with these Terms or your use of this site is limited to one hundred dollars ($100.00). This limitation applies regardless of the form of the claim — contract, tort, strict liability, or otherwise — and regardless of whether we were advised of the possibility of such damages.

Note: This section governs liability related to the website only. Obligations and liability arising from your tenancy, your lease agreement, or the condition of your home are governed by your lease and applicable Michigan landlord-tenant law — not by these Terms.

§ 09 Governing law

These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of this site — that is not resolved informally between the parties — shall be submitted to the exclusive jurisdiction of the state and federal courts located in Oakland County, Michigan. You hereby consent to personal jurisdiction in those courts and waive any objection to venue.

You agree that any cause of action arising out of or related to your use of this site must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

Nothing in this section limits our ability to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened harm.

§ 10 Changes to these terms

We may revise these Terms at any time. When we do, we will post the updated Terms on this page with a revised "Last updated" date. If the changes materially affect your rights — or impose new obligations on you — we will make a reasonable effort to bring them to your attention, including through a notice on the site or by email if we have your address on file.

Your continued use of 58dakota.com after revised Terms are posted constitutes your acceptance of those revised Terms. If you disagree with a change, your remedy is to stop using the site. Your tenancy rights and obligations, again, are determined by your lease — not by these Terms.

The most current version of these Terms is always at 58dakota.com/terms. We do not maintain a public archive of prior versions, but we will provide a prior version to any person who requests it within 12 months of the revision date, upon written request to our office.
