58 Dakota LLC ("58 Dakota," "we," "us," or "our") is a captive property management company. We own and manage residential rental properties in Pontiac, Michigan — nothing else, nowhere else. This Privacy Policy describes how we collect, use, and protect personal information through our website at 58dakota.com, our rental application forms (online and paper), lease documents, tenant communications, and the ordinary course of property-management operations.
We are not a technology company and we do not run a data business. We collect the information we need to operate a property portfolio and keep our residents housed. We hold it carefully, share it narrowly, and do not monetize it in any form.
This policy applies to prospective tenants (applicants), current tenants, former tenants, and visitors to 58dakota.com. It does not cover personal information that our tenants share with third-party services they use independently — payment processors they select on their own, for instance. If you have a question that this policy does not answer, reach the office directly.
Information you give us
When you submit a rental application — paper or online — we collect the information you provide, which typically includes: your full legal name, date of birth, current and prior addresses, phone number, email address, employer and employment history, income and asset information, personal references, and any identification documents required under our standard application process. We collect this information to evaluate your application under our stated criteria and applicable fair housing law.
When you contact us by phone, email, or through the contact form on this site, we retain the content of that communication along with the contact information you provide.
Information about your home
For current tenants, our records include: your executed lease agreement and any addenda, your rent ledger (payment history, balances, credits), maintenance work orders associated with your unit, and correspondence related to your tenancy. This information exists because it is necessary to operate the property and fulfill our obligations as your landlord.
Information collected automatically
When you visit 58dakota.com, our hosting environment logs basic information — IP address, browser type, pages viewed, and referring URL — for the purpose of keeping the site operational and understanding general traffic patterns. We use minimal, first-party analytics. We do not embed advertising pixels, social tracking tags, or session-replay scripts on this site. There is nothing here that tracks your activity across other websites.
Communications
If you opt in to SMS messaging from 58 Dakota, we maintain a record of that consent, including the method by which you opted in and the date. We also retain the content of messages exchanged through our office communications systems, consistent with standard business record-keeping.
We use the personal information we collect for the following purposes, and no others:
- — Application review. Evaluating rental applications, verifying information you provide, contacting references, and making leasing decisions consistent with our criteria and applicable fair housing law.
- — Leasing operations. Preparing and executing lease agreements, processing rent payments, managing security deposits, and administering lease renewals and terminations.
- — Tenancy communications. Contacting you about your tenancy — maintenance requests, building notices, lease matters, rent statements, and other information directly relevant to your household and home.
- — Property maintenance. Scheduling and tracking maintenance and repairs associated with your unit, including coordinating access with our maintenance team.
- — Legal compliance. Complying with applicable federal, state, and local law, including housing and landlord-tenant statutes, record-keeping requirements, and lawful court or government process.
- — Fraud prevention. Detecting and preventing fraudulent applications or other misuse of our services.
- — Site operations. Keeping 58dakota.com functioning, diagnosing technical issues, and improving site content based on aggregate usage data.
We do not sell or rent any personal information — ever, to anyone, for any price.
This section governs our use of text messaging (SMS) to communicate with tenants and applicants. We take our obligations under applicable telecommunications law seriously, and we operate our messaging program in compliance with carrier requirements and applicable federal and state regulations.
Opt-in
You may opt in to text messages from 58 Dakota by checking the SMS consent box on our online application, by initialing the SMS-consent line on a paper lease, or by texting START to our published number. Opt-in is voluntary and is never required as a condition of housing or services.
Use cases
If you opt in, your phone number will be used to send messages directly related to your tenancy with 58 Dakota, including: appointment reminders, tour confirmations, lease renewals and rent reminders, maintenance updates, building notices, and individual operational communications from our office.
Frequency
Message frequency varies based on your tenancy needs. Most residents receive fewer than four messages per month.
Costs
Message and data rates may apply. These charges, if any, are billed by your wireless carrier; 58 Dakota does not bill you for messaging.
Help and stop
Reply HELP at any time for help, including contact information for our office. Reply STOP at any time to opt out of further messages. After replying STOP you will receive a single confirmation message and no further messages will be sent.
No third-party sharing for marketing
58 Dakota does not share, sell, rent, or transfer mobile phone numbers or SMS opt-in / consent data to any third party for marketing or promotional purposes. Mobile information is shared only with subprocessors strictly necessary to deliver the SMS service (our wireless carrier and our SMS platform provider), and only for the purpose of routing your messages.
Carriers
Carriers including but not limited to T-Mobile, AT&T, Verizon, Sprint, U.S. Cellular, Boost, MetroPCS, and others are not liable for delayed or undelivered messages.
Privacy
Information shared with us by SMS, including the content of messages, is treated with the same care as the rest of your tenant record under this Policy.

We retain personal information for as long as necessary to fulfill the purposes described in this policy, comply with applicable law, resolve disputes, and enforce our agreements. Our standard retention schedule is as follows:
- — Active tenant records (lease, rent ledger, maintenance history, correspondence) are retained for the duration of the tenancy plus seven years after the tenancy ends. This reflects standard Michigan business records guidance and ensures we can respond to any legal or regulatory matter that arises after a tenant moves out.
- — Application records for applicants who are not offered a tenancy are retained for 24 months from the date the application was decided. This period allows us to respond to any fair housing inquiry or complaint that may arise.
- — Web analytics data is retained on a rolling 12-month basis. Aggregated and anonymized traffic summaries may be kept longer for general planning purposes.
- — SMS consent records are retained for the duration of the messaging relationship plus three years, consistent with carrier record-keeping requirements.
When information is no longer required, we delete or permanently anonymize it. We do not keep data because it might be useful someday — we keep it because we need it for a stated purpose.
Michigan does not currently have a comprehensive consumer privacy statute equivalent to the California Consumer Privacy Act or Virginia's CDPA. Regardless, we believe you have reasonable expectations about your personal information and we honor them.
You may request:
- i. Access. A copy of the personal information we hold about you, in plain language and reasonable format.
- ii. Correction. That we correct inaccurate or incomplete information in your records.
- iii. Deletion. That we delete your personal information. We will honor deletion requests to the extent permitted by law — meaning we will delete what we can, and tell you plainly what we cannot delete and why (typically because a legal retention obligation applies).
- iv. Opt-out of marketing communications. To unsubscribe from any marketing or non-essential communications from 58 Dakota. Note: as a current tenant, certain operational communications (maintenance notices, building alerts, lease correspondence) are not optional — they are necessary to the tenancy. But you may opt out of any promotional or voluntary messaging at any time.

We will verify your identity before acting on any access, correction, or deletion request, to protect against unauthorized disclosure.
The 58dakota.com website is not directed to children under the age of 13, and we do not knowingly collect personal information from anyone under 13 through this site. If we learn that we have inadvertently received personal information from a child under 13, we will delete it promptly.
If a rental application lists minor children as household members, we collect that information only as necessary for occupancy purposes and maintain it as part of the household's tenant record under the same protections described in this policy. We do not use information about minor household members for any marketing purpose.
If you believe we may have received information from a child under 13 in circumstances you did not intend, please contact us immediately at [email protected].
We update this policy when our practices change or when applicable law requires us to. When we post an update, we revise the "Last updated" date at the top of this page. For material changes that affect your rights or our use of your information in a significant new way, we will notify current tenants by email or written notice before the change takes effect.
We encourage you to review this policy periodically. Continued use of the site or continued tenancy after an update constitutes acceptance of the revised policy, subject to any rights you may have under applicable law.
